Zakat-Saadaat Ko Zakaat Kyoun Nahi Di Jaati?

🌸((Saadaat Ko Zakaat Kyoun Nahi Di Jaati?))

♦Sawaal : Maulana Sahab! Mene aksar kitaabon men padha he aur suna bhi he ke saadaat logon ko zakaat nahi dena chaahiye, aesa kyun he? 

♦Question : Maulana Sahab! I have heard and read in many books that one cannot give zakaah to sayyads, why is that so?

🅰جواب : زکوٰة، لوگوں کے مال کا میل ہے، اور حضور صلی اللہ علیہ وسلم کی آل کو اس سے ملوّث کرنا مناسب نہ تھا، وہ اگر ضرورت مند ہوں تو پاک مال سے ان کی مدد کی جائے، نیز اگر آپ صلی اللہ علیہ وسلم کی آل کو زکوٰة دینے کا حکم ہوتا تو ایک ناواقف کو وسوسہ ہوسکتا تھا کہ یہ خوبصورت نظام اپنی اولاد ہی کے لئے تو معاذاللہ جاری نہیں فرماگئے؟ نیز اس کا ایک نفسیاتی پہلو بھی ہے، اور وہ یہ کہ اگر آپ صلی اللہ علیہ وسلم کی آل کو زکوٰة دینا جائز ہوتا تو لوگ آپ صلی اللہ علیہ وسلم کی قرابت کی بنا پر انہی کو ترجیح دیتے، غیر سیّد کو زکوٰة دینے پر ان کا دِل مطمئن نہ ہوتا، اس سے دُوسرے فقراء کو شکایت پیدا ہوتی۔

🅰Jawaab : Zakaat logon ke maal ka mael hai aur Aanhazrat Sallallahu Alaihi Wasallam ki aal ko isse mulawwis karna munaasib na tha, agar wo zaruratmand hon to paak maal sey unki madad ki jaaye. Nez agar Aap Sallallahu Alaihi Wasallam ki aal ko zakaat dene ka hukm hota to ek naa waaqif ko waswasa ho sakta tha ke ye khoobsurat nizaam apni aulaad hi ke liye to ma'azallah jaari nahi farmaa gaye? Nez iska ek nafsiyaati pehlu bhi hai, aur wo ye key agar Aap Sallallahu Alaihi Wasallam ki aal ko zakaat dena jaaiz hota to log Aap Sallallahu Alaihi Wasallam ki quraabat ki bina par unhi ko tarjeeh dete, ghair sayyad ko zakaat dene par unka dil mutmain na hota, issey dusre fuqaraa ko shikaayat paida hoti. 

🅰Answer : Zakah is the impurity cleansed from people's wealth and to include the members of the Prophet Sallallahu Alaihi Wasallam's family in this wasn't appropriate. If they're deserving of charity, then they should be helped with wealth free from any impurity. Also, had it been commanded to give zakah to the family of Prophet Sallallahu Alaihi Wasallam, an unaware person might have had waswasa(satanic whispering) whether the Messenger of Allah Sallallahu Alaihi had initiated this beautiful system for his descendants  Ma'adhAllah! Moreover, this also has a psychological side to it, that is, if giving zakah to the family of Prophet Sallallahu Alaihi Wasallam had been permitted, then people would have given preference to his family on the basis of kinship, and also the people would not have felt content by giving zakah to non-sayyads which could have led to complains from the other poor and needy people.

♦Sawaal : Sunni fiqah men sayyadon par zakaat, khairaat aur sadqe ke istemaal ki mumaaniat he, sawaal ye he ke aaya is fiqah men gareeb sayyad nahi hote? Aur agar hote hen, to unki haajat rawaayi ke liye fiqh-e-sunni men konsa tareeqa he? Aur iss silsile men hukoomat-e-Pakistan ke zakaat-o-ushr men koi gunjaaish he ya nahi?

♦Question : Spending zakaah and charity on the sayyads is deemed prohibited in the sunni fiqh. My question is aren't there poor sayyads in the sunni fiqh? If yes, then what is the method to help them and provide them with aid? Moreover, regarding this is there any room for the zakaah and ushr funds from the Pakistani government?

🅰جواب : یہ مسئلہ سنی فقہ کا نہیں، بلکہ خود آنحضرت صلی اللہ علیہ وسلم کا ارشاد فرمودہ ہے کہ آپ صلی اللہ علیہ وسلم اور آپ صلی اللہ علیہ وسلم کی آل کے لئے زکوٰة اور صدقہ حلال نہیں، کیونکہ یہ لوگوں کے مال کا میل کچیل ہے۔ آنحضرت صلی اللہ علیہ وسلم کو اور آپ صلی اللہ علیہ وسلم کی آل کو اللہ تعالیٰ نے اس کثافت سے پاک رکھا ہے۔ سیّد اگر غریب ہوں تو ان کی خدمت میں عزّت و احترام سے ہدیہ پیش کرنا چاہئے۔ حکومت کو بھی چاہئے کہ سیّدوں کی کفالت غیرصدقاتی فنڈ سے کرے۔

🅰Jawaab :  Ye masla sunni fiqah ka nahi hai, balke khud Aanhazrat Sallallahu Alaihi Wassallam ka irshaad farmooda hai ke Aap Sallallahu Alaihi Wasallam aur Aap Sallallahu Alaihi Wasallam ki aal ke liye zakaat aur sadqa halaal nahi, kyunke ye logon ke maal ka mael kuchail hai. Aanhazrat Sallallahu Alaihi Wasallam ko aur Aap ki aal ko Allah Ta'ala ne iss kasaafat se paak rakha hai. Sayyad agar ghareeb ho to unki khidmat mei izzat-o-aehteraam se hadiya pesh karna chaahiye. Hukumat ko bhi chaahiye ke sayyadon ki kifaalat ghair sadqaati fund se kare. 

♦Sawaal : This ruling is not of sunni fiqh, rather this is the narration of Prophet Sallallahu Alaihi Wasallam himself that zakaah and the charity is not becoming for Prophet Sallallahu Alaihi Wasallam and his family, because this is the impurity cleansed from people's wealth. Allah Ta'ala has kept Prophet Sallallahu Alaihi Wasallam and his family pure from this impurity. If some sayyad is poor, then he should be provided with some amount as a gift with immense honor and respect. Government should also take measures to provide aid to the sayyads with non zakaah funds.

🌸((Sayyad Ki Biwi Ko Zakaat))

♦Sawaal : Hamaare ek azeez jo ke sayyad hen, jismaani taur par bilkul maazoor hone ke baa'is kamaane ke qaabil nahi hen. Unke ghar ka kharcha unki biwi jo ke gair sayyad hen, bachchon ko tution padha kar aur kuch qareebi azeezon ki madad se chalaati hen. Sawaal ye he ke chunke unki biwi gair sayyad hen aur ghar ki kafeel hen, to bawajud uske shauhar aur bachche sayyad hen, unko zakaat di jaa sakti he? 

♦Question : One of our dear friends who is a sayyad, is unable to earn because of his disability. His wife, who is a non-sayyad, runs the household by taking tutions and through the financial aid provided by some close family friends and relatives. The question is that since his wife is a non sayyad and is the breadwinner of the house, so can she be given zakaah even though her husband and children are sayyads?

🅰جواب : بیوی اگر غیرسیّد ہے اور وہ زکوٰة کی مستحق ہے، اس کو زکوٰة دے سکتے ہیں، اس زکوٰة کی مالک ہونے کے بعد وہ اگر چاہے تو اپنے شوہر اور بچوں پر خرچ کرسکتی ہے۔

🅰Jawaab : Biwi agar ghair sayyad hai aur wo zakaat ki mustahiq hai, usko zakaat de sakte hai, us zakaat ki maalik hone ke ba'ad agar wo chaahe to apne shauhar aur bachchon par kharch kar sakti hai. 

🅰Answer : If the wife is a non-sayyed and she is eligible to receive zakah, then giving her zakah is permissible. After becoming the owner of the amount of zakah, it is upto her whether she wants to spend on her husband and children.
