Zakaat Lene Waale Ke Zaahir Ka Aetebaar Hoga

_🌸((Zakaat Lene Waale Ke Zaahir Ka Aetebaar Hoga))_

*♦Sawaal :* Ai'zza, ahbaab-o-aqaarib jo bazaahir mustahiq-e-zakaat nazar aate hen, ye kis tarah tasdeeq ki jaaye ke ye saahib-e-nisaab hen?

*♦Question :* How do we confirm whether our relatives who seem like worthy recipients of zakah are sahib-e-nisab(owner of wealth) or not?

*🅰جواب :* ظاہر کا اعتبار ہے، پس اگر ظاہر حال کے مطابق دِل مانتا ہے کہ یہ مستحق ہوگا، اس کو دے دی جائے۔

*🅰Jawaab :* Zaahir ka aetebaar hai. Pas agar zaahir haal ke mutaabiq dil maanta hai ke ye mustahiq hoga, usko de di jaaye. 

*🅰Answer :* It depends on one's impression of them. If by looking at their outward situation one's heart is convinced, then zakah can be given to them.

_🌸((Ma'amooli Aamadni Waale Rishtedaar Ko Zakaat Dena Jaaiz He))_

*♦Sawaal :* Meri ek qareebi azeeza hen, unke shauhar ek ma'mooli hesiyat se kaam kar rahe hen, aamadni itni nahi ke ghar ke ikhraajaat ba ahsan chal saken, rehaaishi makaan bhi kiraaye ka he. Jawaab talab amr ye he ke in haalaat men, me zakaat-o-sadqaat ki raqam unhen de sakta hun?

*♦Question :* I have a close relative whose husband is a low-wage worker and his earning is not of the kind which can run the house comfortably. They also reside in a rental house. Considering this situation, my question is whether I can give them zakah or sadaqah?

*🅰جواب :* اگر وہ زکوٰة کے مستحق ہیں، تو زکوٰة کی مد سے ان کی مدد ضرور کرنی چاہئے۔

*🅰Jawaab :* Agar wo zakaat ke mustahiq hen, to zakaat ki mudd se unki madad zaroor karni chaahiye. 

*🅰Answer :* If they're deserving of zakah then they should be definitely helped with the zakah funds.

_🌸((Bhai Ko Zakaat Dena))_

*♦Sawaal :* Ulamaa-e-deen beech is masle ke kya farmaate hen ke agar apna haqeeqi bhai ma'azoor aur beemaar ho aur zariya-e-aamadni bhi na ho, to kya usko dusra bhai zakaat de sakta he? 

*♦Question :* What do the Ulema say regarding an issue where one's brother is disabled and ill and has no source of income, so if one brother wants to give zakah to another disabled brother then is it permissible?

*🅰جواب :* بہن، بھائی اور چچا، ماموں کو زکوٰة دینا جائز ہے۔

*🅰Jawaab :* Behen, bhai aur chacha, maamu ko zakaat dena jaaiz hai. 

*🅰Answer :* It's permissible to give zakah to one's brother, sister and maternal and paternal uncles.

_🌸((Bhai Aur Waalid Ko Zakaat Dena))_

*♦Sawaal :* Agar koi shakhs hisaab kitaab men apne waalid aur bhaiyon se alag ho aur saahib-e-hesiyat bhi ho. Ab agar ye beta waalid sahab ko zakaat iss tarah dena chaahta he ke pehle apne gareeb mustahiq bhai ko de de aur bhai se keh de ke ye raqam aap aur waalid dono istemaal men laaen, ya bhai se keh den ke ye raqam qubool karke waalid ko dena, jabke waalid mustahiq bhi ho, kya ye sahi he ya aesi koi soorat he ke ye raqam waalid ko de di jaaye aur zakaat adaa hojaaye?

*♦Question :* If a person is not associated with the earnings of his father and brothers, and this person is a sahib-e-nisab too then can this person give zakah to his father in such a way that he first hands it out to his brother who is poor and worthy of zakah and either tells him that he(zakah payee) may use that money for himself and their father, or he(zakah payer) tells his brother to accept the zakah money and later on give it to their father who is also an eligible recipient of zakah. Is this correct or is there any other way by which this zakah can be offered to the father and the zakah offered remains valid?

*🅰جواب :* بھائی کو زکوٰة دینا صحیح ہے، مگر اس سے یہ فرمائش کرنا کہ وہ فلاں شخص (مثلاً: والد صاحب) پر خرچ کرے، غلط ہے۔ جب اس نے بھائی کو زکوٰة دے دی تو وہ اس کی ملکیت ہوگئی، اب وہ اس کا جو چاہے کرے۔ اور اگر بھائی کو زکوٰة دینا مقصود نہیں، بلکہ والد کو دینا مقصود ہے اور بھائی محض وکیل ہے، تو بھائی کو دینے سے زکوٰة ادا نہیں ہوگی۔

*🅰Jawaab :* Bhai ko zakaat dena sahi hai, magar isse ye farmaaish karna key fulaan shakhs (masalan waalid) par kharch kare, ghalat hai. Jab usne bhai ko zakaat de di to wo uski milkiyat hogayi, ab wo uska jo chaahe kare. Aur agar bhai ko zakaat dena maqsood nahi, balke waalid ko dena maqsood hai aur bhai mehez wakeel hai, to bhai ko dene se zakaat adaa nahi hogi. 

*🅰Answer :* Giving zakah to the brother is correct. Although, to make such a  request that the zakah money should be spent on a person (for eg: the father) is wrong. When he gave that amount to his brother then that money came under his brother's ownership which he may use it however he likes. And if giving zakah to the brother wasn't intended, rather giving zakah to the father was intended and the brother was merely acting as a representative then giving zakah to the brother will not be considered valid.
