Zakaat Ki Raqam Se Madrasa Aur Mutibb Chalaane Ki Soorat

_🌸((Zakaat Ki Raqam Se Madrasa Aur Mutibb Chalaane Ki Soorat))_

*♦Sawaal :* Hamaare dost Orangi town men ek deeni madrasa qaaim karna chaahte hen, jis mei maqaami bachchon ko hifz-o-naazira ta'aleem-e-Qura'an di jaayegi aur ba'dahu is mei ri'aayati mutibb kholne ka iraada hai. Daryaaft talab amr ye hai ke kya madrase ki tausee aur taameer aur mua'llim ki tankhwaah zakaat, sadqaat se adaa ki jaa sakti hai?? Kya mutibb ki mudd mein zakaat, sadqaat, atiyaat ki raqam li jaa sakti hai??

*♦Question :* One of our close friends desires to establish a deeni madrasa in Orangi town in which the children of the locality will be provided Qura'anic education related to memorising and reciting it, and after that he intends to open a concessionary clinic. My question is, can the construction and salaries of the teachers there be offered from the amount of zakaah or sadaqah? Can zakaah, sadaqah and donations be accepted for the clinic? 

*🅰جواب :* بغیر تملیک کے زکوٰة کی رقم مسجد، مدرسہ اور مدرّسین کی تنخواہ میں استعمال نہیں ہوسکتی، اس کی تدبیر یہ ہے کہ کوئی محتاج آدمی قرض لے کر مدرسہ میں دے دے، اور زکوٰة کی رقم سے اس کا قرض ادا کردیا جائے، یعنی زکوٰة کی رقم اس کو دے دی جائے، جس سے وہ اپنا قرض ادا کرے۔ مطب کا بھی یہی حکم ہے۔

*🅰Jawaab :* Baghair tamleek ke zakaat ki raqam masjid, madrasa aur mudarriseen ki tankhwaah men istemaal nahi ho sakti. Iski tadbeer ye hai ke koi mohtaaj aadmi qarz le kar madrasa mein de de, aur zakaat ki raqam se uska qarz adaa kardiya jaaye, ya'ani zakaat ki raqam usko de di jaaye, jis se wo apna qarz ada kare. Mutibb ka bhi yahi hukm hai.

*🅰Answer :* The amount of zakaah cannot be spent in masjid, madrasa and salaries of teachers without tamleek. A strategy for doing so is that a needy person can borrow money and give it in the madrasa, and then his debt can be paid back from the amount of zakaah, i.e the money of zakaah should be offered to this needy person so that he can clear his debt. The same rule applies for the clinic.

_🌸((Zakaat Se Shifa Khaane Ka Qiyaam))_

*♦Sawaal :* Ek biraadari ke log zakaat wusool kar ke us fund se dispensary qaaem karna chaahte hai, dawaaiyaan zakaat fund ki raqam sey khareedi jaayegi, doctors ki fees, jagah ka kiraaya aur deegar ikhraajaat zakaat se kharch kiye jaayenge, jabkey dispensary se har shaks ameer-o-ghareeb dawaayi ley sakega. 

Ek masla ye bhi hai, jaisa ke idaara zakaat wusool karta hai to wo zakaat mustahiqeen mei taqseem karney ke ba'ad bach jaati he, aaya idaara us zakaat ko usi saal khatm karde ya usey aaenda saal bhi taqseem kar sakta hai? Baraaye karam iska jawaab bhi zaroor likhein...

*♦Question :* People of a particular tribe wish to establish a clinic by collecting zakaah funds. Medicines will be purchased from zakaah money. The fees of doctors, rent of that place and other expenses will be borne from zakaah money, whereas all, wealthy and poor people will be able to take medicines from the clinic.

One more issue is that just like how the institute offers zakaah, so the amount, after distributing amongst the recipients, remains thereafter. Should the institute spend the zakaah that very year or it can also be distributed in the next year. Please do write the answer for this. 

*🅰جواب :* زکوٰة کی رقم کا مالک کسی مستحق کو بنانا ضروری ہے، اس لئے نہ تو اس سے ڈسپنسری کی تعمیر جائز ہے، نہ ڈاکٹروں کی فیس، نہ آلات کی خرید، نہ صاحبِ حیثیت لوگوں کو اس میں سے دوائیاں دینا جائز ہے، البتہ مستحق لوگوں کو دوائیاں دے سکتے ہیں۔

جہاں تک سال ختم ہونے سے پہلے زکوٰة کی رقم خرچ کردینے کا سوال ہے، تو یہ اُصول ذہن میں رہنا چاہئے کہ جب تک آپ یہ رقم مستحقین کو نہیں دے دیں گے، تب تک مالکان کی زکوٰة ادا نہیں ہوگی،اس لئے جہاں تک ممکن ہو اس رقم کو جلدی خرچ کردینا چاہئے۔

*🅰Jawaab :* Zakaat ki raqam ka maalik kisi mustahiq ko banaana zaruri hai, isliye na to usse dispensary ki ta'meer jaiz hai, na doctors ki fees, na aalaat ki khareed, na saahib-e-haisiyat logon ko us men se dawaaiyaan dena jaaiz hai; Albatta mustahiq logo ko dawaiyaan de sakte hai. 

Jahaan tak saal khatam hone se pehle zakaat ki raqam kharch kar dene ka sawaal hai, to ye usool zehen mein rehna chaahiye ke jab tak aap ye raqam mustahiqeen ko nahi de denge, tab tak malikaan ki zakaat ada nahi hogi, isliye jahaan tak mumkin ho, iss raqam ko jaldi kharch kar dena chaahiye.

*🅰Answer :* It is essential to make some eligible person the owner of zakaah money. Hence, spending zakaah in the construction of some clinic, or in the payment of doctor's fees, or in purchasing the equipments or giving medicines to affluent people is not permissible. However, worthy recipients of zakaah can be given medicines from the zakaah money.

As far as the matter of spending zakaah money before a whole year concerns, so this principle should be clearly noted that until and unless you don't offer this amount to some eligible recipient, zakaah of the owners won't be deemed offered. Hence, this amount should be spent earlier as far as possible. 

_🌸((Masjid Men Zakaat Ka Paesa Lagaane Se Zakaat Adaa Nahi Hoti))_

*♦Sawaal :* Ek masjid hai jo committee ke maa tahat chal rahi hai, to iss committee ka maal-e-zakaat qabza karke iss zakaat ke maal ko masjid men kharch karna kaisa hai?

*♦Question :* There's a masjid which is running under committee, what is the ruling about spending the zakaah of the committee in masjid, after taking a hold on the amount?

*🅰جواب :* زکوٰة کا روپیہ مسجد میں لگانے سے زکوٰة ادا نہیں ہوگی۔

*🅰Jawaab :* Zakaat ka rupiya masjid men lagaane se zakaat adaa nahi hogi.

*🅰Answer :* Zakaah won't be offered if invested in any masjid work.
