🌸((Imaam Ko Zakaat Dena))

♦Sawaal : Imaam-e-masjid ke liye zakaat jaaiz hai? 

♦Question : Is it permissible for the imam of a masjid to accept zakaah? 

🅰جواب : اگر وہ محتاج اور فقیر ہے تو جائز ہے، ورنہ نہیں، محض امامِ مسجد ہونے کی وجہ سے تو کوئی زکوٰة کا مستحق نہیں ہوجاتا، امامت کی اُجرت کے طور پر زکوٰة دینا بھی صحیح نہیں۔

🅰Jawaab : Agar wo mohtaaj aur faqeer hai to jaaiz hai, warna nahi. Mahaz imaam-e-masjid hone ki wajah se to koi zakaat ka mustahiq nahi hojaata, imaamat ki ujrat ke taur par zakaat dena bhi sahi nahi. 

🅰Answer : It is permissible to offer him zakaah if he is needful and poor, otherwise not. One cannot become deserving of zakaah merely being an imaam of masjid. Offering zakaah as the payment of imaam is also impermissible.

🌸((Imaam-e-Masjid Ko Tankhwaah Zakaat Ki Raqam Se Dena Jaaiz Nahi))

♦Sawaal : Hamaare ilaaqe men ye dastoor hai ke jab ek aalim ko apna pesh imaam banaate hai to uske liye kisi qism ki tankhwaah ya nafqa muqarrar nahi karte, balke ilaaqe ki rasam ye hai key log ya'ani mohalle waale us imaam ko zakaat dete hai. Pehle se ye taye nahi hota ke me imaamat karunga to mujhko zakaat dena, isliye pesh imaam ko zakaat dena imaam ko bhi ma'aloom hai key rasam ki wajah se hai aur quam ko bhi, kya iss tarah imaamat karne se qaum ki zakaat nikalti he ya nahi? Kya iss tarah imaamat karne mein kuch qabaahat hai ya nahi?

♦Question : There is a rule in our society that when people make a particular scholar their imaam, so nobody fixes any kind of salary or payment for him, rather the custom of the society is that the residents offer the zakaah money to the imaam. This is not fixed in advance that if I do imaamat, you people give me zakaah. The imam and the people, both know that this is the custom of the society. Is the zakaah of the people deemed offered like this? And as for the imaam, is there any kind of detest for him in doing imaamat? 

🅰جواب : اگرچہ امام صاحب سے یہ بات طے نہیں ہوئی کہ ان کو زکوٰة کی رقم سے تنخواہ دی جائے گی، لیکن چونکہ “المعروف کالمشروط” کے اُصول کے مطابق کہ جو چیز پہلے سے ذہن میں طے شدہ ہے، وہ ایسی ہے جیسے کہ اس کی شرط لگائی جائے۔ چنانچہ جب امام صاحب اور زکوٰة دینے والوں کے ذہنوں میں یہ بات پہلے سے ہے کہ اس امام کی کوئی تنخواہ مقرّر نہیں کی جائے گی اور اس کو زکوٰة کی رقم دی جاتی رہے گی، لہٰذا زکوٰة کی رقم سے امام کو تنخواہ یا بالفاظ دیگر اس کی امامت کی اُجرت دینا جائز نہیں؛ البتہ اگر اس کو امامت کی اُجرت الگ دی جاتی ہو، پھر غریب، محتاج ہونے کی وجہ سے اس کو زکوٰة دے دی جائے تو صحیح ہے۔

🅰Jawaab : Agarcha imaam sahab se ye baat taye nahi huwi ke unko zakaat ki raqam se tankhwaah di jaayegi, lekin chunke 

[المعروف کالمشروط] 

ke usool ke mutaabiq ke jo cheez pehle se zehen mein taye shuda hai, wo aisi hai jaise ke uski shart lagaayi jaaye. Chunaancha jab imaam sahab aur zakaat dene waalon ke zehno men ye baat pehle se hai ke is imaam ki koi tankhwaah muqarrar nahi ki jaayegi aur isko zakaat ki raqam di jaati rahegi, lihaaza zakaat ki raqam se imaam ko tankhwaah ya ba-alfaaz-e-deegar uski imaamat ki ujrat dena jaaiz nahi; Albatta agar usko imaamat ki ujrat alag di jaati ho, phir ghareeb, mohtaaj hone ki wajah se usko zakaat de di jaaye to sahi hai. 

🅰Answer : Although this is not fixed in advance with the imaam that he'll be offered salary from the zakaah money, then too, according to the principle

[المعروف کالمشروط]

i.e the thing which is already prevalent in the minds of people is just as being conditional. Hence, when the people and the imam, both know that there will be no fixed salary of the imam and he'll be given zakaah money, hence, offering zakaah as the salary or in other words, payment for imaamat is not permissible. However, if he is separately being given the salary of imaamat, and due to poverty and need, if he is being offered zakaah, then it is correct. 

🌸((Jail Men Zakaat Dena))

♦Sawaal : Jail ke andar namaaz-e-Jumu'ah aur zakaat dena jaaiz hai ya nahi? Agar hai to kya jail ke andar mustahiq qaidi ko de saktey hai ya nahi? 

♦Question : Is Salaat-ul-Jumu'ah and offering zakaah in prisons permissible? If yes, then can we offer zakaah to an eligible prisoner or not? 

🅰جواب : جیل میں نماز تو باجماعت پڑھنی چاہئے، مگر جمعہ کے بجائے ظہر کی نماز پڑھنی چاہئے، جیل کے قیدیوں میں جو لوگ زکوٰة کے مستحق ہوں ان کو زکوٰة دینا دُرست ہے۔

🅰Jawaab : Jail men namaaz to baa jama'at padhni chaahiye, magar Jumu'ah ke bajaaye Zohar ki namaaz padhni chaahiye. Jail ke qaidiyon mei jo log zakaat ke mustahiq hon, unko zakaat dena durust hai. 

🅰Answer : As for salaah in the jail, it should be offered in congregation, but instead of offering Jumu'ah prayer, Zohar prayer should be offered. From amongst the prisoners, zakaah can be offered to the deserving recipients.
